Terms of Use for Forcecartilage
Last updated
Welcome to forcecartilage.world, operated by Pace & Pause from Melbourne, Australia.
These Terms govern access to the website, digital Quiet Atlas materials, physical Walnut Interval Tower goods, Seasonal Rhythm Lab Pass programming, and any future catalogue items we list in Australian dollars.
Agreement to be bound
By browsing, purchasing, or registering, you agree to these Terms, the Privacy Policy, the Cookies Policy, and the Return Policy.
If you disagree, discontinue use and delete any trial downloads you obtained.
Eligibility
You must be at least eighteen years old or have guardian authorisation to charge the payment method on file.
Business buyers warrant that they have authority to bind their organisation to these Terms for bulk Quiet Tools procurement.
Licence to use the website
We grant a limited, revocable, non-transferable licence to view pages, print reasonable excerpts for internal planning, and stream Rhythm Lab sessions you purchased.
You may not scrape inventory data, bypass paywalls, reverse engineer download tokens, or frame the storefront without written consent from Forcecartilage.
Intellectual property
All trademarks, layout designs, lesson scripts, PDF templates, photography, and generative art previews remain owned by Pace & Pause or its licensors.
Purchasing a product grants the usage rights stated on its product page, not a blanket licence to resell digital files.
Orders and pricing
Display prices include GST for Australian customers unless labelled otherwise during checkout experiments.
We may correct typographical errors before accepting payment; if an error slipped through, we will offer a refund or revised invoice before shipping.
Seasonal Rhythm Lab Pass fees cover the cohort you select; transferring to another season may incur an administrative fee published at the time of request.
Payment and fraud screening
Payments are captured through PCI-compliant processors.
We may delay fulfilment if fraud checks flag inconsistent billing data, and we will cooperate with law enforcement if required.
Shipping and digital delivery
Physical goods ship from 40/37-39 Albert Rd, Melbourne VIC 3004 with tracking numbers emailed once manifests close each Thursday.
Digital goods arrive through secure links that expire according to the licence summary on your receipt.
Acceptable conduct during live sessions
Rhythm Lab participants must keep conversations respectful, avoid recording other attendees without consent, and refrain from sharing login credentials.
We may remove disruptive attendees without refund if behaviour threatens the cohort experience after a written warning.
Disclaimer of warranties
Quiet Tools provide educational structure for balancing work and rest; they are not substitutes for professional advice tailored to your circumstances.
The site and products are supplied as is to the maximum extent permitted by the Australian Consumer Law.
Limitation of liability
To the extent permitted by law, Pace & Pause is not liable for indirect, consequential, or punitive damages arising from product use, including lost profits or missed deadlines.
Our aggregate liability for any claim relating to a single order will not exceed the amount you paid for that order.
Nothing excludes liability that cannot be excluded under the Competition and Consumer Act 2010 (Cth).
Indemnity
You agree to indemnify Pace & Pause against claims arising from your misuse of Quiet Tools materials, violation of these Terms, or infringement of third-party rights when uploading content to workshop forums.
Force majeure
Delays caused by events outside reasonable control, including port strikes, extreme weather, or utility outages, pause deadlines but do not terminate your rights once performance becomes possible again.
Suspension and termination
We may suspend accounts that abuse download limits, harass staff, or attempt credential stuffing.
You may close your account by emailing contact@forcecartilage.world with proof of identity; outstanding orders must settle first.
Governing law and venue
These Terms follow the laws of Victoria, Australia, and you submit to the exclusive jurisdiction of courts in Melbourne for disputes exceeding the monetary jurisdiction of VCAT, unless a consumer elects otherwise.
Changes
We will post revisions on this page with an updated effective date rendered dynamically on forcecartilage.ddd.
Continued use after fourteen days constitutes acceptance unless the change reduces a statutory consumer guarantee, in which case we will seek fresh consent.
